1. GENERAL

Unless otherwise agreed in writing, our following conditions apply to all of our sales and deliveries. Changes and deviating purchasing conditions of our client are only binding for us if they have been mutually agreed in writing.

2. VALIDITY OF THE OFFER

Our offers are generally valid for one month from the date of issue.

3. PRICES

If our suppliers do not supply us with the required raw materials in sufficient quantities or at the current price, we reserve the right to make appropriate corrections to the offered and agreed prices and quantities. Prices apply ex works; excluding packaging and transport. Minimum order value Fr. 60.00. The prices, quantities, delivery dates and delivery options listed in our offers are subject to change.

4. TRANSPORTATION COSTS

Deliveries are generally ex works and are charged as transport costs. The LSVA is always exclusive and is shown separately.

5. PACKAGING

Pallets, grids, frames and lids are exchange devices. These devices must be replaced in perfect condition, free of charge. Defective exchange devices will not be accepted. Calculated packing boxes must be returned within a reasonable period of time, postage paid. They will then be credited. Steel straps, cords, bags, etc. are disposable materials and cannot be taken back.

6. QUANTITY

Over- or under-deliveries of up to 10% of the ordered quantities cannot be objected to.

7. SHIPPING

The goods always travel at the expense and risk of the recipient. The transport companies are liable for any damage during transport. Acceptance of damaged goods must be refused.

8. DANGEROUS GOODS

It is the bottler's duty to determine the hazard class of the product being filled. We decline any liability for improper use of the containers or failure to comply with transport and other regulations.

9. WARRANTY, COMPLAINTS, RETURNS

We undertake, at our discretion, to either replace all items delivered by us free of charge or to refund the invoice value of non-replaceable items if a prior inspection by us reveals manufacturing defects or material defects that make the goods unsuitable for their intended purpose. The replaced items are our property and must be returned in their unchanged condition, free of charge. We do not recognize any further claims. The delivered goods are deemed to have been accepted if the buyer does not raise any complaints with basic and delivery receipt information within 14 days of receipt of the goods. In the case of hidden defects, the deadline is extended to one week after discovery, but no longer than six months after receipt of the goods. Excluded from the guarantee are materials and consequential damage to products provided by customers or third-party companies.

10. TOOLS

All tools remain our exclusive property, even if their production costs are borne in whole or in part by the customer. Borrowing these tools is also not possible. On the other hand, we undertake not to produce any products for third parties using these tools without a special agreement. If no repeat order is placed within three years, we are entitled to dispose of the tools or to destroy them.

11. PAYMENT TERMS

The invoice amount is due within 30 days of receipt of the invoice. Deductions for early payments are not permitted and will be charged subsequently. The customer is not entitled to withhold payments, even in the event of complaints.
